Pence asks judge to reject Gohmert lawsuit against him seeking to overturn election results

Vice President Mike Pence has asked a federal judge to toss a lawsuit spearheaded by Rep. Louie Gohmert seeking to overturn election results.

In a 14 page filing, argued the lawsuit should be brought against Congress.

His response states “These plaintiffs’ suit is not a proper vehicle for addressing those issues because plaintiffs have sued the wrong defendant.”

The statement adds that Pence “is ironically the very person whose power they seek to promote.”

Per USAToday “Rep. Louie Gohmert, R-Texas, and a group of other Republicans filed the suit against Pence this week, arguing that the vice president has the constitutional authority to decide which states’ Electoral College votes to count.”

Pence will oversee the congress during the official count of electoral votes January 6th.

Gohmert’s suit argues Pence has the constitutional authority to ignore votes cast for Biden in states Republicans plan to contest results.
